WHAT CAN YOU EXPECT FROM A PERSONAL INJURY CASE?
If you have been injured in any of the above types of accidents, you may be thinking of hiring a personal injury attorney. While every claim is unique, the personal injury case process generally follows a similar set of steps, beginning with your first meeting with an attorney and ending in settlement or trial.
Having the right attorney can be the difference between winning and losing your case, so it is important to ask lots of questions and carefully evaluate the firm you hire. The right attorney will be able to investigate your case and handle insurance companies and paperwork while you focus on getting better. A good attorney will guide you toward the strategy that will produce the most compensation, but the choice on how to proceed is always yours. Therefore, it is critical that you trust your attorney.
When determining who can recover for their injures after an accident, Illinois uses the “modified comparative fault” analysis. Under this system, an accident victim who is partially at fault is not prohibited from bringing a claim against another party unless they are more than 50 percent responsible for the accident. However, the accident victim’s total damages award will be reduced by their percentage of fault.
For example, assume John and Linda get into a car accident. John suffers serious injuries, totaling damages of $300,000. Linda was not hurt. If a jury finds that Linda was 80 percent responsible for causing the accident and John 20 percent responsible, John’s total damages award would be reduced by 20 percent, from $300,000 to $240,000. However, if the jury found that John was 55 percent responsible for the collision, he would be entitled to nothing.
In Illinois courts specifically, it has been determined that damages can be given to the victim for mental distress even if it does not directly relate to physical injury.
